Labour law has been made out to be complex, difficult and uncertain. Its interpretation and application have allowed little consideration for the realities of workplaces, production environments, shops or offices. One of the results of this is that employers frequently blame labour law for unemployment and regard it as being hostile towards the employer. This is absolutely untrue. By and large, and there are exceptions, labour law is balanced, sensible and workable. It certainly does protect employees from the whimsical, arbitrary or unfair acts of employers, but equally it provides employers with the tools to deal with employees who cannot, or will not, perform and “misconduct” themselves, or whose behaviour exceeds the boundaries of what is regarded as acceptable in the employment relationship.
