Bepalings en voorwaardes

1. Inleiding

1.1 Deur die LitNet webblad (www.litnet.co.za), enige gedeelte daarvan (ook OuLitNet [www.oulitnet.co.za], LitNet se Facebook-groep en die LitNet-blogs [https://blogs.litnet.co.za/]) of die LitNet-nuusbrief (gesamentlik die "webblad"), te gebruik, verbind jy jouself aan die gebruiksvoorwaardes soos hier uiteengesit. Die gebruiksvoorwaardes tree in werking op die tydstip wanneer jy die webblad vir die eerste keer gebruik en vorm 'n ewigdurende ooreenkoms tussen jouself en LitNet. As jy nie verbind wil voel deur al die voorwaardes wat hierna volg nie, moet dan asseblief nie hierdie webblad besoek, gebruik en/of bydra tot hierdie webblad nie.

1.2 LitNet is 'n onafhanklike joernaal op die Internet, en word as gesamentlike onderneming deur Ligitprops 3042 BK en Media24 bedryf ("LitNet").

1.3 LitNet streef na die plasing van oorspronklike materiaal en na die oop en onbeperkte uitruil van idees en menings. Die menings van bydraers tot hierdie werftuiste is dus hul eie en weerspieël nie noodwendig die mening van die redaksie en bestuur van LitNet nie.

1.4 Die dienste en inligting wat op hierdie webblad aangebied word, is gratis tensy anders vermeld. Alhoewel LitNet alles in sy vermoë doen om die kwaliteit en akkuraatheid van die dienste en inligting te verseker, moet jy nie aanneem dat dit noodwendig korrek en sonder foute is nie, of dat dit geskik is vir die doel waarvoor jy dit wil aanwend nie.

2. Beperkte aanspreeklikheid en vrywaring

2.1 Jou toegang tot en gebruik van die webblad is op jou eie risiko.

2.2 Dit is jou eie plig om die hardeware, sagteware, en telekommunikasielyne wat jy mag gebruik om toegang tot die webblad te verkry, in stand te hou.

2.3 LitNet maak geen waarborge, voorstellings (uitdruklik of geïmpliseerd) met betrekking tot die webblad of die inhoud daarvan nie. Sonder om afbreuk te doen aan die algemene aard van voorgenoemde, waarborg LitNet nie die waarheid of korrektheid van enige inligting wat op die webblad verskyn nie en dit is jou eie verantwoordelikheid om die waarheid of korrektheid daarvan na te gaan.

2.4 LitNet is nie aanspreeklik vir enige verlies, uitgawe of skade van welke aard ookal wat jy mag ly of aangaan as gevolg van jou toegang tot of gebruik van enige inligting vervat op hierdie webblad nie, insluitend, sonder beperking, enige verlies, uitgawe of skade wat tot stand gekom het as gevolg van een van die volgende:

2.4.1. foutiewe inligting vervat op die webblad;
2.4.2. ongemagtigde toegang of wysiging van die webblad deur 'n derde party;
2.4.3. die onbeskikbaarheid van die webblad;
2.4.4. die vernietiging van jou data of rekenaartoerusting, of die data of rekenaar toerusting van 'n derde party wat jy gebruik het om toegang tot die webblad te verkry.

2.5 Jy vrywaar LitNet teen enige aanmaning, eis of regsaksie wat teen LitNet ingestel word wat direk of indirek voortvloei as gevolg van jou gebruik van, of toegang tot, hierdie webblad.

2.6 LitNet behou die reg voor om hierdie webblad op sy eie diskresie en te enige tyd te verander, op te gradeer of op te skort.

2.7 Jy is self verantwoordelik vir enige inhoud wat jy aan LitNet stuur, op die webblad laai of deur middel van LitNet aan derdes verstuur. LitNet is nie verantwoordelik vir die verlies van enige inhoud wat jy op die webblad laai of deur die webblad verstuur nie en dit is jou eie verantwoordelikheid om self 'n reserwekopie te maak.

2.8 Die opinies op die LitNet-blogs is dié van die blogger self. LitNet is slegs 'n passiewe kanaal vir die verspreiding van materiaal wat deur gebruikers op die webblad geplaas is. LitNet onderskryf nie enige inhoud op LitNet-blogs nie. Die inligting op LitNet-blogs word verskaf sonder enige waarborg.

2.9 Sonder om afbreuk te doen aan die algemene strekking van die voorafgaande, stem jy toe, wanneer jy enige publikasie of ander bydrae op die webblad of die LitNet-blogs plaas, tot moontlike benadeling as gevolg van laster deur ander gebruikers van LitNet wat op die webblad gepubliseer word. Sonder om afbreuk te doen aan die voorafgaande, vrywaar jy LitNet voorts teen enige lastereis wat jy teen 'n ander LitNet- gebruiker mag instel of wat deur sulke ander gebruikers teen jou ingestel word.

3. Privaatheid

3.1 Jy gee toestemming dat LitNet jou persoonlike inligting wat jy aan ons bekend maak deur jou gebruik van die webblad mag versamel. LitNet gebruik sulke persoonlike inligting slegs vir interne doeleindes om die funksionaliteit van die webblad te verbeter.

3.2 LitNet sal nie jou persoonlike inligting met derde partye deel sonder om vooraf jou toestemming te verkry nie, tensy LitNet in terme van die reg verplig is om dit te doen, indien dit nodig is om die webblad te bedryf of as dit in openbare belang is om die inligting vry te stel.

4. Kopiereg

4.1 Die kopiereg en alle ander immateriële goedereregte van die webblad, insluitend die uitleg, ontwerp, kentekens, grafika en multimedia-werke wat daarop verskyn behoort aan LitNet tensy sodanige regte uitdruklik deur die outeur voorbehou is alvorens dit op die webblad gepubliseer is.

4.2 Jy mag sodanige werke besigtig, uitdruk en een kopie daarvan op jou hardeskyf maak, mits:

4.2.1. dit vir persoonlike gebruik is en nie vir enige kommersiële doel aangewend word nie;
4.2.2. jy op alle kopieë 'n weergawe van ons kopiereg-kennisgewing vertoon;
4.2.3. jy nie die werke op sodanige wyse verander tot nadeel van LitNet nie.
4.2.4. Opvoedkundiges mag egter leermateriaal van KlasKamer vir opvoedkundige doeleindes alleen gebruik.

4.3 Sonder om afbreuk te doen aan die bepalings vervat in paragraaf 4.1 hierbo, bevestig LitNet dat die kopiereg in bydraes, artikels en ander literêre werke wat deur jou geskep is en wat jy aan LitNet stuur aan jou behoort. Wanneer jy enige artikels, bydraes of ander literêre werke op die webblad plaas, gee jy daarmee saam ook vir LitNet 'n oordraagbare, ewigdurende, wêreldwye en tantièmevrye lisensie om die werke vir plasing op LitNet te gebruik. Indien die intellektuele eiendom van materiaal wat deur jou aangebied word vir plasing op die webblad aan 'n derde party behoort, onderneem jy om LitNet daarvan in kennis te stel en vrywaar jy LitNet teen enige eis wat die eienaar van daardie intellektuele eiendomsregte teen LitNet mag instel.

4.4 Die handelsmerke en kentekens op LitNet is die geregistreerde, en waar toepaslik die nie-geregistreerde, handelsmerke van LitNet. Niks op LitNet mag so geïnterpreteer word om te beteken dat jy 'n lisensie of die reg verkry om enige handelsmerk sonder LitNet se toestemming te gebruik nie.

4.5 Jy mag nie ons intellektuele eiendom of dié van 'n derde party vir enige doel gebruik sonder ons vooraf skriftelike toestemming nie.

4.6 Alle aansoeke vir die gebruik van ons intellektuele eiendom kan gerig word aan profetiennevh@gmail.com. Indien jy nie binne vyf besigheidsdae 'n antwoord van ons ontvang nie, kan jy aanvaar dat jou versoek van die hand gewys is.

5. Skakels

5.1 Niemand mag 'n skakel, insluitend hiperskakels, rame, merkers of soortgelyke verwysing na enige deel van die webblad maak sonder ons vooraf skriftelike toestemming nie. LitNet mag die toestemming te enige tyd wysig of terugtrek.

5.2 Alle aansoeke vir sodanige skakels kan gerig word aan profetiennevh@gmail.com. Indien jy nie binne vyf besigheidsdae 'n antwoord van ons ontvang nie, kan jy aanvaar dat jou versoek van die hand gewys is.

6. Skakels na derde partye

6.1 Die webblad bevat skakels na ander webblaaie met informasie en ander materiaal wat deur derde partye geskep is. Alhoewel LitNet die skakels met sorg uitkies, kan ons geen aanspreeklikheid aanvaar vir die inhoud van sulke weblaaie nie. 'n Skakel op die webblad na 'n ander webblad beteken nie dat ons die inhoud van daardie webblaaie nagegaan het nie en dit beteken ook nie dat ons daardie inhoud goedkeur nie.

7. Algemeen

7.1 LitNet mag hierdie gebruiksvoorwaardes te enige tyd wysig. Deur die webblad te besigtig verbind jy jouself tot die huidige weergawe van die gebruiksvoorwaardes. Jy besef dat dit jou plig is om jouself vertroud te maak met die opgedateerde weergawe van die gebruiksvoorwaardes.

7.2 'n Sertifikaat onderteken deur die webmeester sal prima facie bewys wees van die datum van publikasie, asook die bewoording van die huidige asook vorige weergawes van die gebruiksvoorwaardes.

7.3 Niks op die webblad moet geïnterpreteer word as 'n aanbod nie maar moet gesien word as 'n blote uitnodiging om met ons besigheid te doen.

7.4 Indien enige bepaling van hierdie gebruiksvoorwaardes nie ten volle afdwingbaar is nie, sal die oorblywende bepalings wel van krag bly.

7.5 Suid-Afrikaanse reg is van toepassing op hierdie gebruiksvoorwaardes asook op die verhouding tussen jou en LitNet in soverre dit jou gebruik van die webblad betref.

These terms and conditions become operational from the moment you access the web page for the first time and form a perpetual agreement between yourself and LitNet.
